Defense ordered the discharge of the last soldier convicted of the Trelew Massacre

The Department of Human Rights and International Humanitarian Law of the Ministry of Defense, headed by Eduardo Jozami, requested this Friday the mandatory discharge from the Navy of Corporal Carlos Amadeo Marandino, convicted of crimes against humanity perpetrated during the so-called “Trelew Massacre”. occurred on August 22, 1972.

The resolution, signed by the Chief of the Navy Staff, Admiral Julio Guardia, is linked to the “commitment assumed by the ministry to implement a human rights policy and integration of the Armed Forces with civil society,” they officially reported.

“It is unacceptable and contrary to law that there are personnel with military status who are, at the same time, convicted of crimes against humanity,” said a statement from the Ministry of Defense.

The Human Rights department of the portfolio acted ex officio before the confirmation of the conviction of Marandino by the Federal Criminal Oral Court of Comodoro Rivadavia for his participation in the so-called “Trelew Massacre” that took place at the Naval Air Base Admiral Zar, where 16 political prisoners who had escaped from the Rawson prison were shot.

In this way, the provisions of Law No. 19,101 for military personnel were fulfilled, which establishes the mandatory discharge of those convicted as a consequence of the sentence of absolute and perpetual disqualification imposed by final sentence.

“It is unacceptable and contrary to law that there are personnel with military status who are, at the same time, convicted of crimes against humanity,” said a statement from the Ministry of Defense.

In this sense, the statement highlighted that the crimes for which Marandino has been convicted constitute crimes against humanity and that this “implies a series of international commitments assumed by our country, among them, the state duty to guarantee adequate punishment for those responsible.”

Likewise, it was reported that the Institute for Financial Aid for the Payment of Retirements and Military Pensions (IAF), the Navy Personnel Directorate, and the Institute of Social Work of the Armed Forces and Security were informed for compliance. (IOSFA).
