The postponement made by Judge Francis Yojary Reyes Diloné will allow the defense lawyer to study the accusation file and prepare the means of defense.

Rosario expressed her disagreement with the preliminary results of Inacif, alleging that the investigations they have carried out are far from the reality of the facts.
In this sense, he said that they will request the Public Ministry to deepen the medical analyzes that were carried out on Esmeralda Richiez in Higuey.

He added “we opposed the postponement of the preliminary hearing until the 20th, the court understood otherwise and granted the period requested by the lawyers of Professor John Kelly Martínez, in order to see the file and prepare to take the stand.”
According to the indictment, Professor Kelly had wild sex with Esmeralda and administered strong medications.
The prosecution body refers in its request for a measure of coercion that it requested preventive detention “to give continuity to the investigation and have the accused linked to the process, since it is a serious act, the possible penalty to be imposed in case of conviction , combined with the condition of teacher in front of the student and the social importance of the fact”.

The Public Ministry established that the professor’s cousin, Rubén Morillo Martínez, is an accomplice in this crime, because “knowing the violent sexual activity that the deceased had with the accused, he proceeded, after the commission of the act, to distract the bloody pants of the defendant”.
For Morillo Martínez, a relative of the victim, he requested the imposition of periodic presentation as a coercive measure.
Regarding the case, the investigation indicates that at night on February 12, the adolescent left the home where she lived with her parents in Vista Alegre, in the company of the teacher, as well as Morrillo Martínez and three other underage students. .
She says that when she returned home, around 12:00 at night, the young woman arrived pale and bleeding, for which her parents helped her and she stayed in her room. The next day the teenager’s parents found her dead in the bathroom of her residence.
