The NGO Transparencia Venezuela pointed out that this year the Supreme Court of Justice will advance more early retirements to judges, assistant lawyers, secretaries and bailiffs, despite the fact that the Judiciary already “spends more to maintain its former officials than those who continue to work in the different courts of the country.
On December 14, the Plenary Chamber of the TSJ approved resolution 2022-007 containing the “Rules that will regulate retirement plans and benefits, of a special nature, for judges, and other officials and administrative and judicial employees at the service of the Judiciary, except those of the Supreme Court of Justice”.
This resolution will last one year and is the sixth that the TSJ has issued on the matter since 2009, he highlighted. Transparency Venezuela.
Article 1 empowers the plenary to grant “with the favorable vote of the absolute majority of its members (…) the special retirement benefit” to judges and employees who do not meet the age and length of service requirements established in the ordinary regulations, as long as “they have reached the age of 40 if they are women and 45 years if they are men”; and “they have completed a minimum of 15 years of service within the Public Administration, five years of which within the Judiciary.”

Those who suffer from a serious illness or present “serious social situations derived from family responsibilities” may also receive a pension without even fulfilling one of the two aforementioned assumptions, states article 2 of the regulations.
Regarding the amounts, article 3 states that special retirements “will be calculated taking 65% as the initial base percentage and will increase up to 80% of the amount of the last salary or normal salary that has been accrued, at a rate 2% for each year of seniority greater than 15 years of service.
However, those who receive this early retirement benefit due to health or family problems, the remuneration will range between 55% and 65% of the amount of the last salary or normal salary received.
One of the reasons given by the TSJ for these retirements was that “the evaluation and adequacy of the entry and exit of the human talent available” is essential for “the promotion of efficiency in citizen care.”
For Transparency, the decision of the Plenary Chamber to adopt this type of early retirement is striking, because the president of the organization, magistrate Gladys Gutiérrez, admitted that the finances of the Judiciary have limitations due to the allocation of the Executive.
