Penal Code, approved by the Senate, establishes new criminal charges and clusters

Santo Domingo.- The Senate of the Republic approved in second reading the Project of Law of Penal Code of the Dominican Republic, in which new criminal charges and multiple sentences are established.

The proposed Law drastically punishes genocide, femicide, hit men and damage with chemical substances, with penalties ranging from 30 to 40 years in prison, while the series of penalties for very serious offenses will not exceed 60 years in prison.

The legislative regulation, presented by Senators Ramón Rogelio Genao and Virgilio Cedano, is structured by more than 400 articles and regulates new criminal types, comprehensively reforming Dominican criminal law, with the purpose of providing solutions to justice for a better functioning of legality, equity and reasonableness.

The piece was sanctioned, with 23 votes from 26 senators present at the legislative work. This did not include abortion in the three causal demanded by feminist groups and other sectors of the country, including several of the legislators themselves.

Among the modifications presented by the regulations is the punishment for harassment or “bullying”, as behaviors that will be sanctioned with socio-educational measures, minor imprisonment and fines, in case of recidivism by a person of legal age, it is sanctioned with major imprisonment.

In the same way, it includes the punishment of gender violence with a greater penalty for those who cause physical, sexual or psychological harm to a person through the use of physical force or economic violence, patrimonial psychological verbal.

OTHER APPROVALS

The senators also approved in second reading the Bill on Cybersecurity Management in the Dominican Republic, proposed by Senator Faride Raful.

The piece aims to strengthen the regulatory framework for the management of cybernetic security of information and communication technology infrastructures of the public administration and critical infrastructures in the Dominican Republic.

The Plenary also approved the second reading of the Law Project that designates with the name teacher Idaliza Elba Feliz Tapia, the Elementary School of the Barrio los Mangos, of the Municipality of Comendador. Proposal by Senator Aris Yván Lorenzo.

In addition, the Bill that establishes the Corresponding Acts of the Executive and Legislative Powers to be Published in the Official Gazette was approved, a proposal by Senators Félix Bautista and Franklin Rodríguez.

In second reading they approved the Bill that declares the Yerba Buena Marimantas as Intangible Cultural Heritage of the Dominican Nation, an initiative presented by Senator Cristóbal Castillo.

The Senate Plenary approved in first reading the Bill that creates the Judicial Districts of Santo Domingo Este, Santo Domingo Norte and Santo Domingo Oeste, an initiative presented by Senator Antonio Taveras Guzmán.

Also, the Bill that creates the Official State Gazette for the Publication of Modified Laws was sanctioned, an initiative of Senator Santiago José Zorrilla. The purpose of this law is to regulate matters relating to the complete publication of modified laws.

Likewise, the senators approved in first reading the Bill that declares the province of Santiago a province of Health Tourism, an initiative presented by the president of the Senate of the Republic, Eduardo Estrella.

In the legislative works of this Tuesday, they approved in first reading the Bill that designates with the name Doctor Luis Eduardo Morel Pouerié the Palace of Justice of the city of Seibó, proposed by Senator Santiago José Zorrilla.

The Plenary also approved, in first reading, the Bill that designates the main building that houses the Ministry of Defense with the name of Ramón Matías Mella y Castillo, an initiative presented by Senator Franklin Rodríguez.

Also, the Bill that modifies Law 511-05 that declares El Seibó as an ecotourism province, presented by Senator Santiago José Zorrilla, was approved in first reading.

Likewise, the Bill declaring the mangroves of the garitas Natural Reserve of Flora and Fauna, located in the municipality of Sánchez, Samaná province, whose proponent is Senator Pedro Catrain, was approved in first reading.

In the session, the Bill of Law that designates with the name of Juan Bautista Rojas Almánzar, the stretch of road from the bridge over the Bacuí River to Alto de los Rojas, Salcedo Municipality, Hermanas Mirabal province, proposal of the Senator Bautista Antonio Rojas Gomez.

The legislators approved in a single reading the Resolution that posthumously recognizes Dr. Ángel María Gatón Calderón, for his contributions and long professional and academic career for the benefit of the Dominican nation, initiative of Senator Franklin Romero.

In addition, a Resolution supporting the President of the Republic, Luis Abinader, the Ministry of Public Health, the Autonomous University of Santo Domingo (UASD), the Ministry of Higher Education, Science and Technology (MESCYT) and the Dominican Medical College was approved. (CMD), for the initiative to promote medical residences in fourteen provinces of the country. The initiative was presented by senators Virgilio Cedano, Iván Silva, Franklin Peña, Ginnette Bournigal de Jiménez, Ricardo de los Santos, Alexis Victoria, Eddy Nolasco, Franklin Rodríguez, Milcíades Franjul, Lía Díaz Santana, José Manuel Del Castillo and Carlos Gómez.

In the session, the diplomatic appointment of Mr. Georges Basha Hazim as concurrent extraordinary and plenipotentiary ambassador of the Dominican Republic in the Republic of Iraq, based in the State of Qatar, proposed by the Executive Power, was ratified.

The senators ratified the diplomatic appointment of Federico Alberto Cuello Camilo as concurrent extraordinary and plenipotentiary ambassador of the Dominican Republic in Brunei Darussalam, based in the Republic of Korea, a proposal by the Executive Branch.

In a single reading, the Resolution recognizing Rafael Alejandro Moreno Cárdenas for his outstanding political career for the benefit of his nation and democracy in the world was approved, a proposal by Senator Santiago José Zorrilla.

In the turn of presentations, Senator Antonio Marte highlighted the works delivered by the Government to Monseñor Nouel province: detachments in communities where it has been requested for years, an extension of the Technological Institute of the Americas (ITLA) and a branch of the Banco de Bookings.

Senator Antonio Taveras Guzmán highlighted the advances in the Penal Code. He valued the modifications to the initiative, which include recognition of the intellectual authorship of crimes, classification of crimes as pyramid schemes, among others.

Senator Franklin Rodríguez submitted a Bill to modify the Tax Reform on Prohibitions on the Importation of Automobiles and other Vehicles, and the Resolution that recognizes Professor Melanio Hernández, for his contributions to education and literacy, through the book Nacho.

Senator Aris Yván Lorenzo called on the people to remain vigilant when the Executive Branch reintroduces the Comprehensive Bill on Human Trafficking, Exploitation and Smuggling of Migrants.

Senator Valentín Medrano criticized the actions that the Government has developed in matters of immigration, citizen security, health, among others.
“I hope they don’t come with a media show,” said Senator Dionis Sánchez, condemning the death of the child Donelly Joel Martínez, in an incident during the Santiago Carnival celebrations.

Referring to the complaints of purchases by political leaders, Senator Santiago José Zorrilla called on the political class not to go back to the old practices, recalling that “peoples who do not know their history are obliged to repeat it.”

Senator Ramón Pimentel assured that in the administrations of previous governments they acted with great imprudence, due to the fact that they did not act ethically, impunity was rampant and opposition leaders were bought.

Senator Ramón Rogelio Genao considered that the best way to honor the memory of the Fathers of the Nation and show love for the Nation is by voting in favor of the Penal Code Bill.

Senator Alexis Victoria asked the political class to try not to take political advantage of the tragedy caused by the death of the child Donelly Joel Martínez.
