Almost a year after the then National Prosecutor, Zoraida Avaloswill send the Constitutional complaint against the former APRA congresswoman Luciana Leonthe Subcommittee on Constitutional Accusations approved the final report that recommended authorizing her to be prosecuted for influence peddling, among other alleged crimes.
The members of the subcommittee debated the final report prepared by the parliamentarian Susel Paredes, the one that was approved by 14 votes, four legislators abstained and one was against.
If this decision is ratified, the privileges that León has for having been a congressman would be lifted and she could be subjected to judicial process for her ties to what are known as Los Intocables Ediles, pressuring officials to approve works in favor of the Municipality of La Victoria during the administration of former mayor Elías Cubas, among other cases.
Parliamentarian Paredes supported the report and stressed that “many of the elements of conviction are based on what has been found in the search of the former congresswoman’s home and office,” such as minutes, documents, and telephone numbers.
In March of last year, the National Prosecutor sent the complaint against León for four alleged crimes: aggravated influence peddling, criminal organization, improper passive bribery and embezzlement by appropriation.
According to the Public Ministry, the former parliamentarian “was the legal and political arm in charge of offering its wide network of contacts with politicians and senior officials, as well as interceding and managing before them to satisfy the requirements and needs of the criminal organization with clear economic purposes.” .
Congresswoman Paredes reported that the former mayor of La Victoria was considered the leader of the criminal organization and he contacted León to act as his political arm with influence in the Executive to favor him with works.
“Elías Cuba derived the works through contests, all well structured because he had a team of lawyers and accountants, so that Alex Peña Quispe’s company (his financier) would execute them,” he said.
He stressed that in the lifting of the secrecy of the former legislator’s communications, conversations were found between her, ministers and general directors who agree to favor certain companies.
“It is not the fact of going to speak with the minister, but that in exchange for going to speak and influence, a payment is received. According to the elements of conviction that are in this file, the former congresswoman would have received a monthly payment of 10,000 soles and a kind of success fee of between 80 and 100,000 soles for each case, “she said.
The next step
After the approval of the report in the Subcommittee on Constitutional Accusationsthe case must be seen in the Permanent Commission and, if approved, it will go to the Full for discussion and voting. In both cases, the former APRA member of parliament has the right to go with a lawyer to present her defense.
If it is approved in both instances, only the Public Ministry will be able to formalize the preparatory investigation and follow a judicial process.
Session on ex-minister Sánchez
The session began with the complaint to the former Minister of Foreign Trade, Roberto Sánchez. Assistant prosecutor Marcos Huamán accuses him of rebellion and conspiracy in the attempted coup of Pedro Castillo.
