The complaint filed by journalist Denisse Legrand against Senator Graciela Bianchi for spreading false information on social networks has generated a great uproar in the country’s political and media community. As published by LARED21 on January 10, 2023, the senator shared an image of Legrand on her Twitter account, along with a text attributed to her, where it was mentioned that the journalist had said that the president of Brazil should summon Chavista troops to repress the Bolsonaristas. These assertions are serious and were considered false information by Legrand and her lawyers.
In their complaint, the lawyers Juan Ceretta and Juan Williman indicated that Bianchi not only disclosed false information, but also added Legrand’s photo, name, professional role, and outlet.generating a large reach on social networks and causing damage to the journalist’s reputation.
Additionally, the complaint also mentions the scope of the privileges that Bianchi enjoys as a senator, article 112 of the Constitution reaches it in the following way: “With the current legislation, a legislator can perfectly be criminally denounced, not for what he says in the camera [del Parlamento]but yes because of what I publish on social networks”.

For lawyers, “the responsibility of a legislator for his opinions in networks is the same as that of any person, he does not have any type of immunity.”
As of today (January 25, 2023) Bianchi refuses to delete the tweet, and responded to the complaint by saying: “Now it is clear that they are trying to limit everyone’s freedom of expression and generate self-censorship.”
“Known lawyers on the same road provide their advice. And if economic benefit can be achieved, it is better: one of the left to obtain money without effort. I repeat: to shut me up they are going to have to kill me, ”he added.
