Requests from the Martinelli Linares brothers in the “Blue Apple” and “Odebrecht” cases are rejected

The Second Settlement Court for Criminal Cases of the First Judicial Circuit of Panama, rejected the request to suspend the preventive detention order and the detention for extradition purposes of the brothers Luis Enrique and Ricardo Alberto Martinelli Linares, in the cases “Blue Apple” and ” Odebrecht”.

Through Various Orders No. 05 and No. 06 of January 6, 2023, the Court decided to reject outright the two requests of the Martinelli Linares brothers, both accused of the possible commission of a crime against the economic order, in the modality of money laundering, in the cases called “Blue Apple” and “Odebrecht”.

The requests were proposed by the lawyer Carlos Carrillo Gomila in favor of the defendants, detained for another cause in the United States of America.

According to the Court, it is not feasible to annul the preventive detention order against these two people, after having reviewed and debated extensively when resolving what concerns the requests for release bonds, which were even raised on appeal, in compliance with the principle of double instance; Therefore, it proceeded to reject said request outright.

Regarding the request to suspend the arrest warrant for the purpose of extradition of the accused, the court stated that, to date, the Court has not formalized the corresponding procedure, therefore, an act not deployed cannot be left without effect. , which is inadmissible in accordance with article 708 of the Judicial Code.
