The Human Rights Secretariat expressed this Friday its repudiation of the decision of the Cassation Fair Chamber to grant the benefit of transitory exits for three repressors convicted of crimes against humanity committed in the ABO circuit, which made up the clandestine detention centers of Atlético, Banco and Olympus.

“On the last day of the fair, before its composition was modified, the Cassation Chamber made up of judges Eduardo Riggi, Juan Carlos Mahiques and Carlos Gemignani decided to revoke the resolution of the Federal Oral Court that had denied the temporary departures requested by the defenses of the repressors Eduardo Emilio Kalinec, Juan Carlos Avena and Luis Donocik,” said the Secretariat headed by Horacio Pietragalla Corti through a statement.

The agency, in its role as plaintiff in the ABO case, had opposed the proposals in the instance of the Federal Oral Court.

In this sense, from the Secretariat it was argued that “granting the benefit of temporary exits would generate a controversy that not only includes its direct victims, but also permeates society in general by virtue of the indelible impression on the collective memory that meant the facts for which the accused was tried and sentenced”.

In this sense, the granting of temporary exits “would deviate without any basis from the provisions of the so-called Victims’ Law (Law 27,372)”.

By virtue of this, with respect to transitory exits, it is appropriate “to adopt a judicial criterion, which takes extreme precautions to avoid circumstances that could lead to impunity when crimes against humanity are judged.”

From the area of Accompaniment and Assistance to Victims, the Secretariat “had an intervention so that the victims were heard, which caused the Court to reject the requests in all three cases.”

Through the decision that was made known today, the Cassation Fair Chamber ruled that these resolutions be revoked.
