SUNAT 2022: See when your annual Income Tax return is due

The (SUNAT) approved the expiration schedule, the forms and other provisions so that taxpayers comply with the timely presentation of the Annual Sworn Declaration of Income Tax 2022 and the Tax on Financial Transactions (ITF).

Thus, the expiration schedule for the presentation of the 2022 Annual Income Declaration will begin on March 24 and will extend until April 11, 2023, according to the last digit of the taxpayer’s RUC, according to the following detail:

Superintendency Resolution No. 288-2022/SUNAT specifies that, in the case of natural persons, Virtual Form No. 709 will be available at and in the People APP as of March 6, 2023, the date on which they will be able to file their declaration, without having to wait for the expiration dates.

As every year, the personalized file will be made available to people, with referential information on income, expenses, withholdings and payments of Income Tax and ITF, so that they can verify, complete or modify it, if applicable, to the presentation of the Annual Declaration.

In the case of companies, Virtual Form No. 710, simplified or complete, will be available in SUNAT Virtual as of January 2, 2023.

In order to facilitate the declaration, this form contains reference information on the balance in favor, payments on account and tax withholdings, as well as the Temporary Tax on Net Assets (ITAN) paid, which has not been applied as a credit against the payments on account.

Required to declare:

Individuals who:

• They would have received Fifth Category Income (workers on payroll) and, at the same time, deduct leasing and/or subleasing expenses.

• Workers who receive Fourth Income (independent workers) and/or Fifth Categories and Foreign Source Income that have a balance in favor of Income Tax.

• Those who have received Fourth and/or Fifth Category Income that attributes rental expenses to their spouses or cohabitants.

• Those who have a balance to pay for First, Second and Work Income and/or Foreign Source Income must also comply with this obligation.

• Those that carry balances in favor of previous years and apply them against the tax and/or have applied said balances, if applicable, against payments on account for Fourth Category Income.

In the case of companies, the obligation to present the 2022 Income Statement is maintained for those taxpayers who have generated income or losses of the Third Category of the General Regime or the Mype Tax Regime (RMT).

Persons or entities generating Third Category Income that have carried out operations taxed with the Tax on Financial Transactions (ITF) for having made the payment of more than 15% of their obligations without using money are also obliged to present the declaration. in cash or means of payment.

Finally, the obligation to submit the 2022 Annual Income Statement has been incorporated to those taxpayers of the General Regime who deduct the tax credits paid for the distribution of dividends or profits.
