President of the Supreme Court by Expert Commission of the constituent process: “I don’t know if it gives greater guarantees, but it is important”

Assessing its importance, although without clarity regarding the guarantees it provides, the president of the Supreme Court, Juan Eduardo Fuentes, addressed the new constituent process that began after the “Agreement for Chile” and that includes three bodies for the drafting of a new Magna Carta. One of them is the Expert Commission, made up of 24 members appointed by Congress.

For the head of the country’s highest court, “it is important that experts participate in issues that are so important for the country, because they have knowledge of these matters.” However, in conversation with The MercuryFuentes expressed a doubt, declaring: “I don’t know if it gives greater guarantees, but it is important, because it will be constitutionalists or experts who write the new text, surely.”

Regarding the upcoming constitutional process, the magistrate added: “I hope that the institutions regulated in the Magna Carta have the opportunity to contribute their background, knowledge and experiences on the areas in which they are competent before the instance that will be created for this purpose”.

Fuentes, in conversation with the morning paper, maintained that “any change in the essential regulations of the fundamental institutions of the State without full knowledge about what they do, without a diagnosis that allows identifying what deserves to remain and what deserves to change, makes very difficult to adopt adequate provisions to improve the lives of the people to whom we provide the public service that we are responsible for, which I understand is the end of an effort of this type”.

Along these lines, Juan Eduardo Fuentes assessed that “the constitutional agreement recently announced is headed in the same direction.”

Let us remember that, by virtue of a pact signed by almost all the political forces with parliamentary representation, this week the constitutional reform that will enable the new process entered the Senate. In addition to the experts, there will be a Constitutional Council made up of 50 democratically elected people and a Technical Admissibility Committee also appointed by parliamentarians.

It is worth mentioning that the Supreme Court has been busy in recent days, in the framework of the failed process to elect a new National Prosecutor, after President Gabriel Boric contacted Juan Eduardo Fuentes to start a new pool of applicants. Fuentes did not refer to the content of that conversation.
