The General Council of the National Electoral Institute (INE) unanimously approved outright dismissing the complaint filed by the National Action Party (PAN) against Morena and Alejandro Esquer Verdugo, current private secretary of President Andrés Manuel López Obrador, regarding the alleged improper use of resources from a trust intended for the victims of the 2017 earthquake, which would have been used to finance campaigns in the 2018 electoral process.
The electoral advisers recalled that the reported events had already been resolved and judged, because although in 2018 the INE imposed a penalty of 197 million pesos on Morena, the upper chamber of the Electoral Court of the Judicial Power of the Federation (TEPJF) revoked it to the consider that the line of investigation was not exhausted, which resulted in an improper motivation and justification, as well as in the violation of Morena’s defense rights by failing to comply with the principle of exhaustiveness

Supervisory capacities
In the discussion of the subject, the counselor Ciro Murayama took the opportunity to celebrate that the TEPJF has confirmed the supervisory capacities of the institute, by recently resolving the appeals on the refusal of the Special Prosecutor for Electoral Crimes (Fisel) to allow them access to research folders. Specifically, he ruled on the cases of the brother of President Pío López Obrador, Odebrecht and the so-called master scam.
However, he also regretted that despite this, the Office of the Attorney General of the Republic filed a dispute with the Supreme Court of Justice of the Nation for not delivering the respective information on the case of Pío López Obrador.
In this regard, Adriana Favela mentioned that, despite the resolutions of the TEPJF, the Fisel still does not provide the required information, so the Legal Directorate is preparing the incidents of non-compliance with judgment
so that the Superior Chamber has knowledge of it.
