Femicide sentence reduced René Maltez

Femicide sentence reduced René Maltez

The Nicaraguan justice system reduced from 30 to 25 years in prison the sentence that had been imposed on the femicide René Maltez Rivas, who stabbed to death the young medical student Cheyling Rachelly Munguía, in June of last year. At the same time, they leave open the possibility that the subject leaves long before the new established date.

The confessed femicide would be released until June 2051, but with the reduction of five years he will be released on June 10, 2046. The sentence modification was given by the magistrates of the Criminal Chamber of the Court of Appeals of the Eastern District of Masaya, made up of Martha Leiva Ayon, William Howard López and Adela Auxiliadora Cardoza.

Maltez, 22, had confessed to the crime at a trial hearing held on January 12 of last year, in which he told the court that he would admit the facts of his own free will. The forensic doctor declared that the young woman had several stab wounds to her neck, in addition to numerous blows to her face, arms and other parts of her body, which evidenced the viciousness with which the defendant carried out the crime.

The Granada Penitentiary System left open the possibility that Maltez would be released long before the new established date, ordered him to be incorporated into the labor prison system, which will allow him to use his days to pay for the sentence.

Judge Claudia Munguía Payán had sentenced the femicide to 30 years in prison and since then he had been kept in the Granada Penitentiary System under a common regime. In her appeal, defense attorney Migdalia Osorio argued that the judge did not take into account the mitigating factors in favor of her defendant, such as having admitted facts and not presenting a criminal record.

Munguía was in her fifth year of Medicine at the National Autonomous University of Nicaragua (UNAN-Managua) and after completing general medicine she aspired to obtain a specialty in oncology.

The accusation relates that after committing the crime, the attacker proceeded to wrap the body in sheets and black plastic bags to transfer it to the bathroom with the intention of evading justice and hiding the evidence, he also proceeded to clean the room.
