The complaint of Vice President Cristina Fernández de Kirchner in the case for the assassination attempt on September 1, demanded that the cell phone of the PRO national deputy Gerardo Milman be kidnapped, before evidence “that is growing”according to a new test incorporated.
“At this point in the investigation, we consider it imperative to kidnap the cell phone whose analysis is most important for the investigation, that of Gerardo Milman,” said the representatives of the Vice President, José Manuel Ubeira and Marcos Aldazábal, in the letter to which Télam had access. .
The new request for evidence was made before the judge of the case María Eugenia Capuchetti and the federal prosecutor Carlos Rívoloto whom the magistrate delegated the investigation.
“We ask the judge (since this measure is exclusively jurisdictional)” to “proceed to the immediate seizure of the cell phone of national deputy Gerardo Milman,” the complaint requested.
Subsidiarily, it asks “to request, immediately, authorization from the Chamber of Deputies to proceed with the kidnapping of the cell phone” of Deputy Milman, if he deems it necessary.
The complaint clarified that Milman as a legislator has immunity from arrest “but in no case from prosecution.”

The legislator “could only be summoned to provide an investigative statement, and not testimonial,” warned the complaint and therefore considered that “Milman should only be called when the factual platform that surrounds him is clearer. In the same writing, the prosecution was asked to arrange other pieces of evidence related to the “Milman tip”, including a request for reports on “all phone lines” of Milman, his advisors Carolina Gómez Mónaco and Ivana Bohdziewicz and two other people, Hernán Carrol and María Alejandra Mroue.

In that sense, They remarked that one of Milman’s advisers changed the phone a week before handing it over to the prosecutor Rívolo for an expert opinion and the other deleted “in its entirety” the content of hisafter “taking advice”.
The lawyers stressed that one of them, Carolina Gómez Mónaco, declared that she had not known anything about the requests for reports on the custody of the Vice Presidentprior to the attack.

The evidence “has been accumulating (except for those destroyed by his advisers; destruction that, by itself, is also an indication of criminality) and kidnapping Milman’s cell phone is prevailing,” they concluded.
The investigation of the so-called “Milman track” has deepened in recent weeks after the Buenos Aires Federal Chamber refused to remove Capuchetti from the case at the request of the complaint, but ordered measures around this line of investigation.
Capuchetti had delegated the case to Rívolo shortly before and decided not to resume the investigation despite a statement in this regard from the prosecutor, after being confirmed.
Rívolo then ordered evidence, summoned national deputies Mario Leito and Marcos Cleri, and Milman’s advisers, Carolina Gómez Mónaco and Ivana Bohdziewicz, to testify.
