The five defendants for the destruction in the Central Obrera Departamental will sit down again this Thursday (08:05) before a judge at an appeal hearingin which the Prosecutor’s Office and the affected institution will seek to reverse their house arrest so that they can be sent preventively to the Palmasola prison.
The defendants in this case are: Kevin Leonardo López Cáceres, José Carlos Quinteros Barbery, Arnoldo Job Nava Palenque, Erick Andrés Suárez Pérez and José Carlos Espiranzay. They are accused of alleged crimes of public incitement to commit a crime, criminal association and aggravated robbery.
This appeal hearing is given at the request of the prosecutors commission that is investigating this case, made up of Nancy Carrasco, Carmen Guzmán and María Toledo, that requests that the substitute measures be revoked for the five young people accused of the destruction in the COD.
The lawyer Hugo Vaca, who sponsors the defendants, indicated that the member Julio Nelson Alba, of the Third Criminal Chamber, will be asked to grant unrestricted liberty to the defendants, since it considers that there is no evidence against him and points out that the Public Ministry presented an accusation without solid foundations.
“We will ask for unrestricted freedom because there are no objective, material and real elements that demonstrate the commission of the crimes of public incitement to commit a crime, criminal association and aggravated robbery. In addition, I believe in justice and I consider that the vocal Alba is a proven person, ”he told the media.
Vaca knows about the extreme measure requested by the Prosecutor’s Office, but it indicates that there are not enough indications to order detention in jail, for which reason it believes that “in the worst case, the alternative measures will be maintained.”
On November 15, precautionary judge Roberto Arias ordered the release of five of the seven accused of robbery and destruction of the Central Obrera Departamental. Two of them underwent an abbreviated procedure accepting four years in prison.
The alternative measures for released persons are: home detention from 9:00 p.m. to 6:00 a.m., arraigo, prohibition to approach the offices of the COD, personal bond with a guarantor and the weekly presentation to sign an act.
The other two defendants, Edwin Barba Pedraza and Enoc Luna Cornejo, received a four-year prison sentence in Palmasola, after undergoing an abbreviated procedure in which they agreed to be guilty of the crimes of public incitement to commit a crime, criminal association and aggravated robbery.
Barba and Luna were the last two people to be apprehended of the total of 17, after the clashes recorded on Friday, November 11 on Irala avenue and surrounding streets, among supporters of the MAS and blockers who supported the strike in favor of the census.
According to the Felcc reports, these two people were supposedly captured after being identified by the images from the security cameras of the place. A television, a chair, a helmet were seized and other elements, which were allegedly taken from the COD.
