The magistrate pointed out that the prosecutor Juan Carlos Ruiz Díaz charged José Samir Samaniego on Wednesday, but he failed to add how long it will take to present his accusation, as required by the Criminal Procedure Code.
The prosecutor presented the accusation against Samaniego for the punishable act of coercionbut he did not specify when he will finish his investigation and present his accusation, due to this omission is that the judge could not admit the accusation and prosecute the young man, nor could the date for the hearing for the imposition of alternative measures to prison be set.

Samaniego is the third accused along with Héctor Grau and Marcelo Fretesfor the brutal attack he suffered in the early hours of November 6 at a Benjamín Zapag nightclub.
José Samir Samaniego did not hit Zapag, but threatened a witness who saw the beating in the bathroom from the discotheque, that if he identified Fretes and Grau who was also going to attack him, “we are going to solve this outside,” he told the witness.

Grau and Fretes, are currently being prosecuted for serious injury and for that reason they are in preventive detention that they are serving in the Tacumbú prison. Both filed appeals and requested the application of house arrest, but Judge Lovera denied them and confirmed the prison for both.
