The Public ministry requested the Second Investigating Court of the National District dictate opening of trial against four police officers and the civilians accused of the death of the young man David de los Santos Correawho died as a result of the beatings he received in a detachment jail after being detained and handed over to the Police by members of the security of a shopping mall.
Kelvyn L. Colón Rodríguez, prosecutor of the National District, asks Judge Patricia Padilla to set the preliminary hearing to hear the request for opening trial against Police Captain Domingo Alberto Rodríguez Rodríguez, Second Lieutenant Germán García de la Cruz, Private San Manuel González García and/or Private Sari Manuel González García and Corporal Alfonso Decena Hernández.
In addition, against the civilians Santiago Mateo Victoriano, Michael Pérez Ramos and Jean Carlos Martínez Peña, as well as against the security agents of Ágora Mall Ambriori Montero Otaño, Álvaro David Beltrán Pérez, Yubaris Méndez Ferreras and Juan Reyes de la Cruz.
david de los santos Correa, 24 years old and resident of Los Alcarrizos, died on May 1 at the Doctor Darío Contreras Hospital, after being held in the police station in the Naco sector, where he was taken around 9:00 a.m. On the night of April 27, the police officers who received him from the private security of Ágora Mall who detained him for presenting alleged inconveniences within the commercial establishment.
Prosecutor Colón Rodríguez asks the court to issue an order of opening trial against the defendants Santiago Mateo Victoriano, Michael Pérez Ramos and Jean Carlos Martínez Peña, by the criminal association commission to commit voluntary homicide, torture and barbarityin violation of articles 265, 266, 295, 303-4 numerals 2 and 9 and 304, of the Dominican Penal Code.
The instance establishes that police captain Domingo Alberto Rodríguez Rodríguez, second lieutenant Germán García de la Cruz, private San Manuel González García (Sari Manuel González García) and corporal Alfonso Decena Hernández they committed abuse of authority, illegal detention and imprisonment, voluntary homicide, torture and barbarityin violation of articles 186, 198, 265, 266, 295, 303-4 numerals 2 and 9, 304 and 341 of the Dominican Penal Code and article 153 numerals 3 and 4 of Law 590-16 Organic Law of the National Police.
Meanwhile, it says that the accused Ambriori Montero Otaño, Álvaro David Beltrán Pérez, Yubaris Méndez Ferreras and Juan Reyes de la Cruz, private security of the Ágora Mall square, incurred in the commission detention and illegal confinementto the detriment of the victim, “for which reason there is sufficient evidence that jeopardizes his criminal responsibility.”
The prosecutor requests that police officers Santiago Mateo Victoriano, Michael Pérez Ramos, Jean Carlos Martínez Peña, Domingo Alberto Rodríguez Rodríguez and Germán García de la Cruz be kept in preventive detention.
In addition, that the coercive measures imposed on private San Manuel González García (Sari Manuel González García) and corporal Alfonso Decena Hernández be changed to preventive detention, “since they do not present guarantees to appear at the acts of the process and submit to it after the presentation of this accusation request, because they do not have sufficient roots to rule out a flight risk.”
The Public ministry it also considers necessary the imposition of a measure of coercion consisting of economic guarantee, impediment to exit and periodic presentation for the accused Ambriori Montero Otaño, Álvaro David Beltrán Pérez, Yubaris Méndez Ferreras and Juan Reyes de la Cruz.
