The judge of Río Gallegos Claudio Vázquez prosecuted ex-volunteer soldier Franco Castelli, a former member of Revolución Federal, the organization accused of issuing intimidating and hateful messages and trying to impose ideas by force, and lThe national deputy Máximo Kirchner and any member of his family were prohibited from coming closer than 200 meters.

This was reported by judicial sources, who indicated that the federal judge he seized Castelli for a million pesos, although he did not impose preventive detention on him.

“Franco Castelli is credited with having formed part, at least from August to September of this year, of the group called “Federal Revolution”, with activity on the social network Twitter and registered under the user @revolucionfed”, wrote the magistrate.

“Meanwhile, from said space, hate messages, intimidating acts and violent demonstrations were planned, coordinated and disseminated; Using social networks and mass media of communication for the convocation and propagation of these intentions, under a scheme designed to impose their ideas and fight those of others by force or fear, and publicly incite collective violence against members of the Executive Power and Legislative Power of the Nation and supporters, among others, of the Frente de Todos political coalition,” he added.

The case began on September 14 past, after the authorities of the XI Mechanized Brigade of the Argentine Army -based in Río Gallegos- learned that one of the volunteer soldiers, Castelli, He would have participated in “public demonstrations that could be considered threats, incitement to commit crimes, incitement to violence, and apology for crimes against national authorities.”

The file mentions an audio in which “an exchange is noticed between Castelli and the citizen Jonathan Morel (organizer of the group, and investigated by the federal justice of CABA) in which the latter asks the accused ‘¿¿You still pass by Máximo’s house, right? Yes, because you’re from Santa Cruz… How come you didn’t kill him, stupid?” to which the defendant replied “yes…if I’m from Gallegos, I’m here.”

“The virtual meeting continues and then Morel launches a series of phrases with intimidating content, in these terms: ‘Today I saw how Cristina greeted the Cámpora and the militancy. Too bad they already know me, because if you don’t know how I infiltrate and wait for it to come down. If the children of the Cámpora did not know me, I would go and sing the Peronist march, and as soon as I can, I would go down in history. Then they lynch me, but I go down in history. Also, and in relation to President Alberto Fernández, there were demonstrations of the following tenor ‘in a few years I know that I am going to cross it and I am going to make my homeland’“, he continues.

Judge Vázquez held that “Federal Revolution would find itself involved in a series of violent escraches, damage to State property and demonstrations with violent slogans, occurred between July and September of the current year; in all cases directed against officials of the national government”.

“After analyzing the evidence submitted for consideration, the hypothesis of the charge was understood to be plausible, both with regard to the materiality of the fact and the criminal responsibility that Castelli bears for his commission”, added.

The magistrate clarified that “it is not being considered that these statements have resulted in acts typical of the beginning of the execution of crimes of this caliber; but the mere intervention of the accused in a group that promotes hatred and fear is enough to configure the fact investigated, as will be seen in the pertinent section”.

And then he said that “Federal Revolution was not simply a group of people upset with the political, economic and social situation that our country is going through, but It was a group that progressively became radicalized both in their expressions of hatred and aggression and in the concrete actions they adopted when they protested.”

“I cannot overlook in this sense that At the same time as these events, there was an assassination attempt perpetrated against the current Vice President of the Nation, Dr. Cristina Fernández de Kirchner.. My opinion in this regard is that, despite the fact that there is no direct connection between those involved in both cases, it is undeniable that the violent messages of Federal Revolution contributed in some way to provide a predisposing climate for this to happen”the judge asserted.

He then held that “Castelli, knowing the inclinations of the group and communing with their way of proceeding, actively participated in their virtual activity.”

“It is clear to me – he added – that it would not have been the first time he interacted with members of the Federal Revolution. For this, it is enough to take into account that in said conversation Morel asked him if he was still passing by Máximo Kirchner’s house, which suggests to me that the leader of the group knew in advance that Castelli was a native of Río Gallegos and that he knew where the deputy was domiciled, information that he necessarily had to provide previously”.

“In light of the evidence collected, Franco Castelli can be charged with the commission of the crime provided for and punished in art. 213 bis of the Penal Code of the Nation, as author (conf. art. 45 of the aforementioned regulations)”, he said.

That article represses “reclusion or imprisonment of three (3) to eight (8) yearsyes, the one I will organize or take part in groups permanent or transitory that, without being included in article 210 of this Code, tFor their main or accessory purpose, they impose their ideas or fight those of others by force (…)”.

After arranging the seizure of “one million pesos ($1,000,000)” on Castelli’s assetsJudge Vázquez also resolved “the prohibition of Franco Castelli’s approach and communication with respect to deputy Máximo Kirchner and any member of the family environment.”

“The causant You will not be able to get closer than 200 meters from where the aforementioned are located, in order to protect their personal safety. You will also be informed that, in case of default the order given here, will proceed in accordance with the provisions of art. 239 of the Penal Code, which punishes with imprisonment from 15 days to a year who disobeys an order from a public official, in this case a judge.
