“I am not a prostitute”, Esperanza Gómez’s response to Instagram because she closed her account claiming that she sold “sexual services”

The model and porn actress Esperanza Gómez arrived before the Constitutional Court, after filing a guardianship for the closure of her social networks, in this case, Instagram, for the content she published.

This Tuesday was the session with the high court, in which the model and businesswoman assured that her right to work is being violated.

“I showed activities like cooking, having a healthy diet, I uploaded photos in my underwear and everyone censored me. I was hired by brands, not only to do adult entertainment activities. But for Instagram, being a porn actress means everything is porn,” she said.

He assured that many brands are followed by his followers.

“Before they had 5 million, now I only have 600 thousand and that makes prestigious brands no longer pay attention to my work,” he said.

Despite this, the representative of Facebook in Colombia said at this hearing that he has no responsibility for the activation, deactivation or content of Gómez’s Instagram account.

Academics from different universities are present at this audience, which begins early in the morning and ends at 5 in the afternoon.

«I make similar posts (to others) on this social network, but everything Esperanza Gómez does on Instagram and for Instagram is pornographic. It seems to me the last straw that a person with the public notoriety that I have, they want to classify her in something that is not 100 percent pornography, “she added.

In the virtual hearing, Gómez also pointed out that a photo of lingerie is not pornographic but that Instagram does turn it into that.

«I want to create a precedent, that we have the right to work. There is a girl who worked with me and because she is transsexual, they also closed her account. We cannot continue to allow these platforms, because they are private companies, to have the right to violate our rights,” Gómez added.

Gómez assures that he never infringed copyrights since he “posted” real content suitable for all audiences, complied with legal regulations, respected other members of the community, did not threaten or harass anyone and always used appropriate language.

However, from one moment to the next, his social network was closed with more than five million followers for allegedly violating community standards.

The Colombian, has told the Court, that: “I am not a prostitute”, because according to what Instagram has done, it is to indicate that she “sold sexual services”.

The position and defense of the actress for adulthood has divided opinions.

The fact that he has brought his complaint before a judicial platform has transcended borders, because if it is ruled in his favor, this could create a precedent in days when there are complaints from all sides, due to the operation of networks such as Facebook, Instagram and even TikTok.

“These networks also work with those who make content for them, we have the right to complain,” it has been read in comments from those who support the Colombian.

His legal battle is against Facebook Colombia, Instagram Colombia and Meta Platforms.
