Yesterday was a day of setbacks for the president peter castle and his government. Not only the Subcommittee on Constitutional Accusations of Parliament approved the report that recommends impeaching him by impeachment for the alleged crime of treason against the country and violation of the Magna Carta. The Constitution Commission also sent to the archive the project presented by the Executive, last April, to repeal Law No. 31355 referring to the application of the question of trust. With this, he took away arguments from the government to propose this mechanism before the Plenary, as announced, days ago, by the premier Hannibal Torres in order, according to analysts, to pave the way for an eventual closure of Parliament.
ACCUSATION
The parliamentary day began very early with the debate and vote in the Constitutional Accusations subgroup of the report that not only concludes in the accusation against the head of state, but also recommends his disqualification from exercising public office for five years.
Eleven votes endorsed the report and sealed the fate of Castillo, who was notified of the decision yesterday, through a letter sent by the president of the Legislative Assembly, Joseph Williamswho invited him to the session of the Permanent Commission that will be held on Wednesday, November 16, in order to make his right to defense effective in person.
The decision generated a chain reaction in the Executive, from where the head of Justice, Félix Chero, attacked the congressmen calling them “legal ignorant”while Alejandro Salas, from the Labor portfolio, anticipated that they will use the accusation as a defense argument before the OAS mission that will arrive in Lima next week.
In the meantime, as we pointed out above, the Constitution Commission Shelved the project that repeals Law No. 31355 referring to the application of the question of trust and on which the Castillo government filed an unconstitutionality claim before the Constitutional Court (TC) which was declared unfounded.
Hernando Guerra García, president of the working group, specified that the “measure will prevent misuse of trust issue” by the Executive for “propose constitutional reforms and any other matter that is the exclusive and exclusive competence of other powers of the State, including Congress”.

Finally, 16 legislators supported the decision, which aroused the anger of the president, who, from Moyobamba, launched a veiled threat announcing that “in the next few hours” he would give a “forceful answerand”. (President Castillo’s reaction) is clearly a serious threat against Congress. In his speech he does not talk about the Constitution or the rule of law; he speaks of respect for the supposed people he represents. As Juan Manuel Serrat would say, (the president) “speaks on behalf of those who do not have the pleasure of knowing”.
I think we can get closer to a dissolution of the Congress because if he says that the confidence issue has been misrepresented by Congress, he will most likely argue that there has been a factual refusal, thus dusting off the argument he used Martin Vizcarrato resign from the cabinet, appoint a new one and say that it goes 1-0, which adds up to the dissolution of Congress.
