Ositrán applied sanctions and penalties for more than S / 7 million to eleven concessionaire companies

Between January and September of this year, the Supervisory Agency for Investment in Transportation Infrastructure for Public Use () applied to 11 concessionaire companies of transportation infrastructure for public use, sanctions and penalties for a total amount of S/ 7 million 172 thousand 746.

The sanctions were given for non-compliance with its normative and contractual obligations. The Ositrán Supervision Headquarters reported that, in compliance with its oversight function, the regulator applied 22 sanctions to concessionaire companies for an amount of S/ 6 million 413 thousand 182 and nine penalties for a total of S/ 759 thousand 564.

Port infrastructure and waterway

Of the penalties applied by the Ositrán, to this sector, 5 were imposed on the company APM Terminals Callao SA for an amount of S/ 5718, all for breaches of service levels and productivity in the port; and to the Concessionaire Company Hidrovía Amazónica SA (COHIDRO) for S/ 662 thousand 400, for the extemporaneous presentation of a Final Report of the Detailed Environmental Impact Study (EIA-d).

Of the 13 sanctions applied to concessionaire companies in this sector, 4 sanctions for the sum of S/ 149 thousand 638 were imposed on the concessionaire Terminal Portuario Paracas SA, 6 for a total of S/ 1 million 022 thousand 580 were applied to the company APM Terminals Callao; 2 to the concessionaire DP World Callao SRL for S/ 21,712, and one to Transportadora Callao for S/ 736; all due to non-compliance with service levels and productivity in the ports under concession.

On railways and Lima Metro

There is a record of a penalty applied to the concessionaire Ferrocarril Transandino SA for an amount of S/ 85 thousand 254, for breaches related to the custody and preservation of the Concession Assets and to respond for damages.

Likewise, 5 fines were applied to the Tren Urbano de Lima SA concessionaire for a total of S/ 4,942,378, the highest amount being that imposed for poor maintenance of pedestrian and vehicular walkways (S/ 4,735,010), and a warning sanction to Ferrovías Central Andina SA for noncompliance related to the strategic shareholding of the concession.

Airport concessions

In this sector, a penalty of S/ 5,842 was imposed on Aeropuertos del Perú SA for failure to have awarded and executed the work called General Painting of the Piura Airport Passenger Terminal, without having a technical file approved by the grantor.

Likewise, a penalty of S/ 276 thousand 138 was applied, for not having a user service module and office at the Chachapoyas airport.

In road infrastructure

In this sector, a penalty of S/ 1,910 was imposed on the company Intersur Concesiones SA, for the untimely delivery of the Quarterly Report on the Environment, Industrial Safety and Occupational Health.

On the other hand, it applied a warning sanction to the Chancay-Acos SA Concession Consortium for the application of tariffs without complying with the methodological adjustments established in its concession contract, ordering, in addition, the imposition of a corrective measure, to restore the situation altered by the infraction, to its previous state.
