Ex-conventional Chahin files a protection appeal against the DC after suspension of militancy: “I think everything has its limit”

The ex-conventional Fuad Chahin filed a protection appeal before the Court of Appeals of Santiago after the supreme court of the Christian Democracy (DC) decided to suspend his militancy in the community.

The document in question informs that “I have come to file an action or appeal for constitutional protection, contemplated in Article 20 of the Political Constitution of the Republic, against Resolution No. 035-2022, of November 2 of this year, issued of a supposed or self-proclaimed supreme court of the Christian Democratic Party and, therefore, of the Christian Democratic Party (…) legally represented by Aldo Sigisfredo Mardones Alarcón”.

“I allow myself to record that the disciplinary process in question was instructed and built in bad faith, between the alleged complainants with the alleged Supreme Court, led by Mr. Andrés Parra Vergara, with the intention of preventing this appellant from being a candidate for the ‘ National Council’; for this, they made use of a request presented on a holiday, which was resolved promptly, that is, the next day by a Court that was elected at the time with 15 members, which has a quorum of absolute majority, that is, eight members and despite this, five people decide with great expedition and without complying with internal regulations,” the letter adds.

in conversation with ThirdChahin explained that “sadly I have had to resort to ordinary justice to try to establish or restore some rule of law within the party and to stop using pseudo institutions to politically persecute those of us who think differently and, in In my case, deprive me of the rights of a militant, not only to participate in the national board, but also not to be a candidate for the national council”.

“I believe that everything has its limit. Therefore, I have had to resort to justice so that in some way I can defend my constitutional guarantees that have been permanently violated by this party’s pseudo-institutionalism,” added the former conventionalist.

It should be remembered that the suspension occurred on November 1, when a group of militants from the DC asked the Supreme Court of the store to expel Chahin for “contravening party discipline.”

Thus, the court decided to suspend his militancy for 60 days after having taken a different option from the one agreed by the party’s national board in the exit plebiscite of last September 4, where the DC went for Approval and Chahin leaned towards the Rejection.
