Elvia Barrios: Report of the JNJ recommends dismissing the president of the Judiciary

The member of the National Board of Justice (JNJ), Guillermo Thornberry, recommended to the Plenary to remove the president of the Judiciary, Elvia Barriosalleging that her husband contracted with the National Elections Jury (JNE) when he was impeded by law.

In report No. 026-2022, which was accessed Peru21it is pointed out that Eduardo Laca Rivadeneira signed service orders with the JNE between January 2015 and July 2018, at which time Barrios was already serving as supreme judge.

The electoral body is presided over every four years by a supreme judge elected by the Plenary Chamber of the Supreme Court, an instance that has been a member of Barrios Alvarado since 2011.

Thornberry, who invoked the impediments to hiring family members of high-ranking officials stipulated by the State Hiring Law, concluded that the magistrate incurred serious disciplinary misconduct by not declaring that her spouse worked for the JNE.

Sources close to the head of the Supreme Court told Peru21 that the case was seen by a Prosecutor’s Office some time ago and that it was archived when no responsibility was found. “However, now the JNJ says that Elvia Barrios should have denounced her husband,” the sources said.

The document also reads that a similar sanction should be imposed on Supreme Judge Javier Arévalo and former judge Vicente Walde. A sanction is also recommended for both for hiring relatives.

Process

From the JNJ they explained to this newspaper that the report of Thornberry, instructor of the ongoing case, still has to be seen in a hearing that will take place the first week of November.

They detailed that after listening to their arguments, the members of the Plenary will vote for or against these conclusions.
