The dictatorship of Daniel Ortega and Rosario Murillo, through the Attorney General’s Office (PGR), confiscated a property located on Carretera Sur, Managua, under the argument of “public utility”, with the aim of creating the “National Center Specialized for the Training of Search, Salvage and Rescue Brigades”, which will be administered by the Nicaraguan Army.
Through the administrative agreement 21-2022published in the official newspaper La Gaceta, on Tuesday, October 18, the PGR made official the confiscation of the farm, which belonged to Claudia Albertina Rosales Marenco, Douglas Poessy Marenco and Orlando Poessy Marenco.
The property seized by the Ortega administration has approximately 432,578.7 square meters and is located next to the Serranías district, kilometer 12.8 on the South highway, 1.5 kilometers south-west.

One of the arguments of the PGR to declare the property of “public utility” is that the State is obliged “to develop actions to ensure the protection of human life and material means of the population and the State, in the face of possible natural or provoked disasters. , be these environmental or sanitary ».
He points out that there is an “imperative need to have” a specialized center to train soldiers in search and rescue of people in danger, “that allows helping the population, in situations of risk, that endanger its life and its material assets, as well as State assets” .
The Office of the Attorney General also alleges that the provisions of article 44 of the Political Constitution of Nicaragua “guarantee the right of private property of movable and immovable property, of the instruments and means of production. By virtue of the social function of property, this right is subject, for reasons of public utility or social interest, to the limitations and obligations imposed by law regarding its exercise.
In addition, the administrative agreement indicates that in accordance with the Code of Organization, Jurisdiction and Military Social Security, the Nicaraguan Army has the function of “contributing to strengthening the risk management policy, in cases of natural disasters, carrying out actions of organization, training , prevention, attention and mitigation, safeguarding the life and property of the population, collaborating in the maintenance of order and reconstruction.
It also requests the people affected by this declaration of “public utility” to appear within 15 days before the PGR to reach an “advent”.
