Due to the lack of a specific rule on non-working days, the Federal Judicial Power (PJF) has up to four holidays more than the official calendar, including September 14, which was declared as such, initially, to commemorate the annexation. from Chiapas to Mexico. This lack of clarity causes confusion and labor conflicts for litigants and the general public who have to go to federal courts and tribunals to resolve their issues.

Non-working days in the PJF are governed not only by the Federal Labor Law, which establishes the mandatory breaks for most private companies and government bodies, but also includes those included in the Organic Law of the Judicial Power of the Federation and the Protection Law.

Thus, the non-working days for the PJF include several dates that are not listed as mandatory breaks, such as the recent October 12, but also September 14, November 1 and 2 and three days of Easter.

The diversity of laws that come together to declare holidays within the PJF means that several of these dates coincide, but others do not, said José María Soberanes Díez, professor and researcher in Law at the Universidad Panamericana.

The Amparo Law had been drawn up by a man from Chiapas (Emilio Rabasa Estebanell), and he said: well, the annexation of Chiapas has to be commemorated, and he put there on September 14Soberanes Diez explained.

This forces trial lawyers to have to be aware of non-working dates in federal courts and tribunals, since these also apply to legal terms, that is, the deadlines set by law to file amparos, appeals, lawsuits and others. written.

Soberanes Díez proposed as a solution to make a general law of holidays, applicable not only for the PJF, but for all workers, government and private, throughout the country.
