Congress: They propose that those sentenced for collusion, embezzlement or corruption not apply in municipal elections

The bench of at the initiative of congresswoman Katy Ugarte, presented a bill that proposes to promote the suitability of candidates for popularly elected public office.

It’s about the which proposes to modify literal h) of numeral 8.1, of article 8 of Law No. 26864, Law of Municipal Elections.

According to the document, they seek to strengthen the filters for the election of local authorities. With the amendment, said device would be worded as follows:

“Article 8.- Impediments to apply

They cannot be candidates in the municipal elections:

h) Persons who are sentenced to imprisonment, effective or suspended, with a consented or executed sentence, for the commission, as perpetrators, of intentional crimes of collusion, embezzlement or corruption of officials, even when they have been rehabilitated ”.

The statement of reasons indicates that our legal system has been implementing new tools to strengthen the fight against corruption, the same ones that have been reinforced to combat and banish any crime that may cause harm against the State.

In this sense, he states that it is appropriate to tighten the impediments to running as a candidate, since the crimes of collusion, embezzlement or corruption have a high degree of harmfulness, “by weakening the confidence of the population in the Government and its authorities, and subsequently, the democratic order and the rule of law”.

He explained that the figures left by corruption are not an isolated event, because in 2020, corruption and functional misconduct caused losses to the country for approximately 22 billion soles, while for 2019 it was around 23 billion. of soles, with respect to the assigned budget.

For this reason, it specifies that the project seeks to extend the impediment to candidates participating in municipal elections, when they have been sentenced to imprisonment, effective or suspended, with a consensual or enforceable sentence, for the commission of said crimes.

“In order to sanction these behaviors that are harmful to the Nation, it is necessary to extend this impediment to prevent people without scruples, or respect for the public administration, from reaching a municipal chair”narrowed down

“In the same way, this measure can serve as a dissuasive element, which contributes to the reduction in the commission of corruption crimes, by constituting a cut in the political rights of people”sentenced.
