The Rio de Janeiro court ordered the release of 72-year-old actor José Dumont, arrested in the act on September 15, at home, by police officers from the Child and Adolescent Victim Police Station (DCAV), for the crime of storing images of sex involving children. The release order is from the 3rd. Criminal Chamber of the Court of Justice, in trial session. The process is under judicial secrecy. The measure was taken on Tuesday (11).
The acting president of the Criminal Chamber is judge Suimei Cavalieri. In the decision, the magistrate wrote: “Unanimously, the order was partially granted to relax the patient’s imprisonment, determining the immediate issuance of a release permit, but with the substitutive imposition of alternative precautionary measures, under the terms of the rapporteur’s vote”.
According to the Court of Justice, the preventive detention was removed because the actor is being prosecuted for the crime of art. 241-B of the Child and Adolescent Statute (ECA), by storage of images of pornographic scenes. According to the Criminal Procedure Code, pre-trial detention is not allowed in this situation. However, José Dumont will have to comply with alternative precautionary measures, such as electronic monitoring.
The artist was imprisoned in the Casa do Albergado Crispim Ventino, dedicated to the elderly, in the Gericinó Penitentiary Complex. Dumont will have to undergo medical attention, since he is hypertensive, has thyroid problems and gastritis.
