FIFA does not enter the 'Gimnastics-Boca case'

The FIFA will not enter to investigate the incidents of last Thursday in the duel of the Argentine league between Gimnasia La Plata and Boca Juniors at the Carmelo Zerillo Stadium. Incidents derived from the use of tear gas by the police and that ended with the death of a fan and several injuries.

Its position is explained in the Disciplinary Code of the highest institution of world football where it already makes clear in its article regarding the application regime that “This code is applicable to all matches and competitions organized by FIFA, as well as to all association football matches and competitions that do not belong to the jurisdiction of the confederations and/or the federations, unless otherwise stipulated in this code.”

But here the jurisdiction belongs to the AFA, the Argentine Football Federation and, consequently, to CONMEBOL, the confederation on which it depends.

In this same line is article 27 of the Disciplinary Code relative to the general norms where it makes it clear that “the confederations, federations and other sports organizations are responsible for investigating, prosecuting and sanctioning the conducts maintained in their respective jurisdictions. In particular, the confederations shall have jurisdiction in disciplinary matters relating to friendly matches and competitions between national teams or clubs belonging to the same confederation, as long as the competition is not organized by FIFA.” In fact, AFA already issued a harsh statement hours after what happened where it made clear its rejection and desire to clarify everything that happened. CONMEBOL also issued its corresponding statement.

Condemnation of AFA, FIFA and CONMEBOL

So did FIFA, as the highest institution in world football, but aware of these limitations that the second paragraph of the same article 27 certifies. FIFA’s competence “in disciplinary matters related to the matches and competitions it organizes, competitions between national teams or clubs belonging to different confederations; likewise, FIFA will have jurisdiction in disciplinary matters relating to matches played by invitational teams made up of players registered with clubs belonging to federations of different confederations”.

This also explains that FIFA has not entered to investigate unfortunate events in Indonesia. This does not mean that President Gianni Infantino did not have a conversation with the President of Indonesia, Joko Widodo.
