A file from the Court of Honor of the Lima Bar Association (CAL), to which Peru21 was able to access, reveals new details of the dark past of Javier Leon Mancisidornew owner of the State Attorney General’s Office (PGE)who ended up being suspended for four years (since 2017) from practicing law.
The alleged commission of a fraud in collusion with the drug trafficker Fernando Zevallos —alias ‘Lunarejo’—, in which the Prosecutor’s Office accused him of the crimes of illegal appropriation to commit a crime, falsification of documents and procedural fraud, would have been paralyzed in the Judiciary since 2019. However, the case also reached the CAL, where it was determined that there was a “fraudulent” action, as well as “improper and illegal conduct, configuring criminal acts.”
THE CASE
The complainant, Ramón Miranda, recorded as the owner of Lumiere Maritime Inc., agreed in 2002 to transfer the shares and rights of his company to Zevallos, who has been serving a sentence since 2005 for drug trafficking.
The agreed price was more than US$1.6 million, which would be paid at the rate of US$10,000 per month. However, Zeballos failed to pay, so Miranda proceeded to terminate the contract and initiate an eviction action.
However, according to the CAL file, by that date a fraudulent meeting of shareholders of Lumiere Maritime Inc. had already been held, which revoked the power of Miranda, the original owner, and granted powers of representation to the current attorney Javier León.
The now owner of the PGE —according to the CAL— constituted a life usufruct on a property and entered into an out-of-court transaction with Zeballos, transferring ownership of this asset to another company for S/600,000.
In his defense before the CAL, León alleged the expiration of a disciplinary action because the events occurred in 2011 and that, as a criminal proceeding had been brought against him for the same reason, he described the complaint before the CAL as an improper avocation (assuming jurisdiction).
However, the CAL determined that the actions of fraud “are proven” and that “the ethical infractions imputed to the lawyer León Mancisidor are extremely serious and denigrate the legal profession.”
For the general secretary of the Transparency Civil Association, Iván Lanegra, León is not suitable to be head of the PGE and puts at risk all the cases that this institution sees, including the investigations of President Pedro Castillo and his closest environment.
