Municipality meets with car attendants to organize paid parking

The Superior Court of Electoral Justice (TSJE) detailed this Friday about the types of electoral propaganda that will be in force as of November 16, due to the simultaneous internal elections.

The electoral body indicated that propaganda on public roads, which can be carried out from November 16 to December 15, is understood as the exhibition of the candidate’s photograph or name, even if the list or order number is not included, in paintings on the walls, posters, parades, posters, gigantographs, LED screens, among others.

On the other hand, the publication of images, audios or videos that are related to candidates for elective positions, in order to convince the voter to vote for that preference through the media, will be valid from December 6 to December 15.

In this sense, the Electoral Justice emphasized that Failure to comply with the rules for advertising on public roads is a punishable act that is punishable by a fine equivalent to the damage caused, according to Art. 328 of Law 834/1996. If incurring in a fault ruled by the courts of fault of the communes, a penalty of fine provided for in the ordinances of each municipality will be established.

The Electoral Court of the Central Department also recalled what Articles 294, 295 and 296 of the Electoral Code refer to, regarding the prohibition of propaganda on bridges, public buildings, monuments, traffic signs and pavement.

It is worth mentioning that violating the deadline for electoral propaganda in the media is sanctioned by the Criminal Prosecutor’s Office, which can act ex officio or based on a complaint, with a fine equivalent to 500 minimum wages applicable to directors or managers of the medium in question, according to Art. 329 of the Electoral Code.

In addition, Article 291 of the aforementioned regulations establishes that electoral propaganda in the media must not mislead or confuse the voter. It will be the power of the Electoral Court of the corresponding constituency to suspend the broadcast of propaganda, if it incurs in what is detailed in Art. 291.
