The FGE/JLP #420/2022 report issued this Friday, rejects starting a trial against the former president, Evo Moralesfor the case of terrorism and points out as an argument that there should be a formal complaint with all the facts described against the person; or in the event of a trial of responsibilities, it must be accompanied by a formal indictment attached to the Law judged by High State Authorities.
“It follows that the same does not constitute a formal complaint or complaint filed against any person, within the framework of the provisions of Articles 285 and 290 of the Code of Criminal Procedure, nor nor does it constitute an Accusatory Proposition according to the content of Law 044 dated October 8, 2010”, indicates the text of the note that was communicated to the former deputy, Amilcar Barral Cabero, who had requested the prosecution of the former president in compliance with the recommendations contained in the IACHR report on the terrorism case.
On September 25, the IACHR report on the terrorism case was released and the third recommendation of that report states, “Initiate a diligent criminal investigationeffectively and within a reasonable time in order to fully clarify the facts, in addition to Yoidentify all possible responsibilities and impose the corresponding sanctions regarding the serious human rights violations recognized in this report,” which was considered a recommendation to the authorities in office at the time.
