The Constitutional Court of the Judicial Power declared as inadmissible the amparo actions formulated by Yen Vilcatoma Y Lourdes Flores Nanowhich sought to annul the general elections of 2021, in which Pedro Castillo was elected.
In the case of the resolution that rejects what was proposed by Flores Nano, the court argues that the request cannot proceed because “The nullity of an electoral process affects the exercise of the rights to political participation of political organizationscandidates, authorities in consultation and citizens who exercise their right-duty to pay, generating serious consequences for said rights”.

While in the Vilcatoma case, the judge considered that “the request of the lawsuit are not directly referred to the constitutionally protected content of the right invoked”.
In both cases, the protection was against the National Elections Jury, the highest electoral body in charge of announcing the results.
It should be noted that the 2021 general elections, in which Pedro Castillo was declared the winner, had international observation missions, which did not detect any irregularities that would cast doubt on the legality of the process.
