Despite the fact that Nallar’s transfer had already been cancelled, the members Ever Álvarez and Wálter Pérez decided to install the appeal hearing this afternoonbecause the new resolution of Judge Vedia had not arrived physically.
The First and Third Criminal Chamber, of members Ever Álvarez and Wálter Pérez respectively, revoked the resolution issued on September 27 by the judge of La Guardia, Rodrigo Aldo Vedia, who ordered the transfer of Misael Nallar Viveros, from the Chonchocoro prison in La Paz, to the Palmasola prison in Santa Cruz.
With this ruling, Nallar, the main accused of the triple murder in the municipality of Porongo, will serve 180 days of preventive detention in the city of La Paz. Misael Nallar must remain until November 24, 2022 in the Chonchocoro prison, as long as their legal situation does not improve,” said Juan Pablo Ibáñez, lawyer for the families of the victims.
This morning, the precautionary judge Rodrigo Aldo Vedia, rectified its previous ruling of September 27 and annulled the transfer to Palmasola of Misael Nallar, main defendant in the murder of three uniformed men in Porongo, on June 21.
Already in the appeal hearing, the members of the First and Third Criminal Chamber considered that the police reports were not correctly evaluated indicating that Nallar’s life was never at risk in Chonchocoro, La Paz, as alleged by his defense attorneys.
It was for that reason that ordered that Judge Vedia’s ruling be overturned which was issued on September 27, which orders the immediate transfer of the main accused of the triple crime to the Palmasola prison.
In the hearing that took place this afternoon virtually, Misael Nallar viveros asked the judges to speak and began to question the director of the Regime Chonchocoro Penitentiary. “I want to ask him to look me in the face, to ask him if he has the cynicism…” Nallar began to claim. However, the member Wálter Pérez interrupted the accused to ask him not to make personal objections and only talk about the appeal hearing .
It was thus that Nallar changed the tone of his defiant voice and began to speak more slowly to denounce that he is humiliated in the La Paz prison. “They deny me medical care, they deny me medication, They deny me everything here. They humiliate me, they urinate on my clothes, they throw coffee on my bed, they throw my soup on me,” said the detainee when requesting that he be transferred to the La Paz prison.
While the lawyer for the families of the victims, Juan Pablo Ibáñez, asked the Ministers of the Government, Eduardo Del Castillo, and the Minister of Justice, Iván Lima, help to get to the historical truth of the facts and condemn those accused of this triple crime.
The victims of this violent event that took place on June 21 are: Sergeant Major Eustaquio Olano, 2nd Sergeant Alfonso Chávez and the Gacip volunteer, Daniel Candia Orihuela.
The following are already under arrest for this murder: Misael Nallar, in the Chonchocoro prison in La Paz; Widen Nallar, in Palmasola de Santa Cruz; and Jassir Góngora, is also in this same prison. The others implicated are: Rodrigo Gonzáles Arrázola and Esteban Beltrán Muñoz, the first is defending himself in freedom and the other is detained in Palmasola.
