President of the TSE orders the removal of news linking PCC leader to Lula

After analyzing Lula’s campaign request, Moraes stated that the publication conveys “a fact that is known to be untrue, with serious decontextualization”, with the apparent intention of linking the candidate to the criminal organization.

The minister stressed that the TSE has already judged other cases in which it faced the alleged connection between the PCC and Lula, concluding that the information was false. Returning to publishing untrue information on the subject constitutes “an obvious intention to compromise the fairness of the elections, in view of the integrity of the information regarding the candidates”, wrote Moraes.

The publication was published yesterday (1st), with the title “Exclusive: in PF interception, Marcola declares vote for Lula”. Moraes, however, concluded that “from reading the report, there is no evidence of Marcola’s vote for the candidate Luiz Inácio Lula da Silva”.

“Actually, the transcribed dialogues, in addition to relating to prison conditions, have only a political connotation, as they portray an alleged discussion by Marcola and other interlocutors regarding Luiz Inácio Lula da Silva and Jair Messias Bolsonaro”, highlighted Moraes. “Although the content of the dialogues reveals a comparative discussion between the candidates, there is no declaration of vote, a fact that is constant in the title of the news”, added the minister.

Moraes’ decision also affects other vehicles that replicated the news, such as Radio Jovem Pan and the portal Earth, and also profiles of President Jair Bolsonaro, candidate for reelection, among other pages on the internet. The minister established a daily fine of BRL 100,000 in case of non-compliance and of BRL 15,000 in case of recidivism.

In note, the antagonist classified the injunction as “censorship” and said that “Moraes’ decision welcomes, without the right to contradictory, arguments of the PT’s campaign lawyers”.
