Judge John Paredes Salas, of the Third Constitutional Court of Lima, admitted for processing the application for amparo filed by the head of the PNP Special TeamColonel PNP Harvey Colchadoagainst President Pedro Castillo, in order to order the cessation of the alleged violation of his fundamental rights.
According to the resolution to which he agreed The Republicthe prosecutors of the Presidency of the Council of Ministers and the Ministry of the Interior have 10 days to respond to the demand, while the single hearing will take place on June 14, 2023.
Colchado wants the complaint filed against him by the head of state before the PNP Inspectorate to be shelved and Castillo Terrones to be ordered to refrain from “intimidating” Colonel PNP with administrative procedures.
He also intends that the Ministry of the Interior be exhorted not to remove him from the position of head of the PNP Special Team, which supports the Special Team against the Corruption of Power, nor from the head of the Digimin Search Division.
Intimidation and obstruction
Harvey Colchado, in his lawsuit, denounces having been subjected to intimidation by President Pedro Castillo due to his status as head of the PNP Special Team, in charge of carrying out the proceedings in the six tax investigations that follow the president and his entourage.
The alleged intimidations that Colchado mentions are the complaint before the PNP Inspectorate for the capture of Yenifer Paredes, sister-in-law of the president, in the Government Palace, and the removal of the high command of the Police.
Likewise, Colonel PNP warns of an alleged obstruction in his work as head of the Digimin Search Division, since the necessary resources have not been allocated for his office.
For this reason, Harvey Colchado affirms that his rights to the free development of the personality, to dignity, to the full exercise of public function, to due administrative procedure would be violated due to the affectation of the guarantee of impartiality, the principle of proportionality, balance of powers, collaboration between powers and good administration.
