A prosecutor from La Matanza ordered a new psychiatric expert report for a man who had been considered “unimpeachable” after firing 11 bullets at the front of the house of a hairdresser and stylist in the Buenos Aires town of Ramos Mejíaparty of La Matanza, in the past month of May, after considering that the initial diagnosis had “insurmountable errors”, informed judicial sources.
This was ordered by the head of the Functional Instruction Unit (UFI) 6 of said jurisdiction, Mariana Sogio, who accepted the proposal of the legal representatives of Carlos Alejandro Monteverde, a coiffeur who was attacked in his house located on Colombia de Ramos Mejía street on May 18.
That day, as proven in the case, after 6:00 p.m., Lucas Hernán D’Adamo (42) fired eleven times at the facade of the Monteverde residence, while driving in a black BMW car and shouting “I’m going to kill you son of a bitch, you who are on the SIDE”.
About, the victim stressed that she did not know her attacker and that “he had only cut her hair a couple of times”.
The detention
After the fact, D’Adamo was arrested and charged with the crimes of “aggravated abuse of weapons, aggravated threats, carrying a firearm for civilian use and illegal carrying of a weapon of war.”
However, the official psychiatric experts considered that “he did not understand the will of his actions at the time of the events”, for which he was transferred to Unit 10 of Melchor Romero, which functions as a neuropsychiatric hospital.
“He presents a pathology of the order of psychosis, which requires continuing with psychopharmacological and psychotherapeutic treatment under the current hospitalization modality,” the specialists indicated in the official expert opinion that was incorporated into the file.
In contrast, prosecutor Sogio ordered a new psychiatric examination for next Monday, after accepting a request from the plaintiff’s attorney, Pablo Darío Gómez de Olivera.
This request was based on a report by the psychiatric expert on behalf of Rafael Herrera Milano, who considered that the initial diagnosis presented “insurmountable contradictions and errors.”
“The report is based solely on the statements of the interviewee, but there is no reference to the eventual verification of the same based on the records of the file”, assured the forensic psychiatrist Herrera Milano in the document presented before the Justice, and suggested that The accused must have previously undergone psychophysical examinations since he was a legitimate user of 6 firearms, according to Amnac reports.
In turn, Herrera Milano, who was also an expert in the lawsuit in the cases of the femicide Fernando Farré and the cumbia singer “El Pepo” Rubén Darío Castiñieiras, stressed that the same official report presented irregularities, since throughout it it was argued that the accused “did not show alterations in his mental faculties.”
“In short, there is no indication of psychiatric hospitalization at the time of the exam. The conclusion that D’Adamo has not been able to act with will at the time of the events is nothing more than a dogmatic assertion without scientific support that is locked in its own contradictions, “said the expert witness.
In this regard, the intervening psychiatrist highlighted in dialogue with Télam that in this type of case “psychiatric expertise is essential.”
“There is no doubt who was the author of the act on this occasion. One of the main objectives of this request was to prevent them from trying to psychiatrise purely criminal behavior,” Herrero Milano told this agency.
