The most relevant institution for the life of the country is the Presidency of the Republic, not only because of the power that the person who holds the position has, but also because the Constitution It establishes that the president embodies the nation and, therefore, represents us all.
The claim of Antauro Humala of running for the presidency has opened a debate on the relevance of a convicted murderer being able to “embody the nation” even though he has served his sentence.
The Constitution, with its amendments, establishes that persons sentenced to imprisonment, consented or executed, for committing an intentional crime cannot apply for the Presidency, Vice Presidency or Congress. Criminal offenses related to terrorism, illicit drug trafficking, violation of sexual freedom, collusion, embezzlement or corruption of officials are included. These impediments are in force even when they have been rehabilitated.
It is logical then the proposal of the congressman Charles Anderson to include the crime of murder within the impediments to apply, because we cannot allow the person who represents us to be a murderer so declared by the courts of our country.
supporters of Antauro Humala they are going to say that it is a constitutional amendment with its own name. They are partially right since this case is the one that has exposed this constitutional vacuum. But that is no reason to leave open the possibility of having a person who is not up to the task to exercise the country’s chief magistracy.
We must seek that the Presidency be exercised by people free of moral and ethical questions because it would be the beginning of the degradation of the nation as a whole.
