InfoCDMX seeks to apply sanctions to dependencies that fail to comply with transparency

Recently Political Expansion published that the Secretariat of Citizen Security and the Prosecutor’s Office of Mexico City are the agencies with the largest number of review resources before the InfoCDMX, the majority because the information requesters said they were dissatisfied with the responses of the agencies.

In this context, Guerrero García pointed out that with this reform to its internal regulations, what InfoCDMX seeks is to provide the agency with greater powers to impose administrative or economic sanctions directly, without going through the internal control bodies.

To do this, this issue is already being discussed between the commissioners and the legal area.

“We are also analyzing who can impose the sanctions, whether on the agency or the official, because imagine that I impose a sanction on an obligated subject and then that obligated subject pays the sanction with the same public resources, then rather, the economic sanction that is being designed is going to be directed to the public servant who pays it from his pocket”, he pointed out.

He said that -from his perspective- for the proposal to apply sanctions to public bodies for not complying with transparency obligations to materialize, a reform of the law is not required, since it is clear, however, it is necessary that the InfoCDMX have “teeth” to enforce the law.

“The norm tells me how to materialize the transparency law, that is, it tells me the catalog (of sanctions), it tells me the substantive part, but not the adjective part,” he said.

He warned that once the internal regulations are changed and the first reprimands begin to apply, the InfoCDMX could face a series of various amparo lawsuits against it.
