The Public Ministry warns that the third extradition process against the former supreme judge Cesar Hinostroza against Spain is paralyzed due to a request made by the Specialized Attorney for Corruption Crimes of Officials before the Executive.
In a statement published On the night of Friday, September 16, the Office of International Judicial Cooperation and Extraditions of the National Prosecutor’s Office indicated that the third extradition notebook had not been forwarded by the Ministry of Justice and Human Rights to the Spanish authorities.
The provincial prosecutor Ángela Arévalo Vásquez, in charge of this office, announced that the ministry has not sent the notebook despite the fact that it was declared as appropriate by the Government on March 11 last “as a result of the request made by the attorney” .
Specifically, it was the anti-corruption prosecutor Javier Alonzo Pacheco Palacios who requested to suspend the active extradition process before the Foreign Ministry.
“This decision was made arguing that it was necessary to complete the processing of other existing extradition requests against Hinostroza Pariachi,” the statement said.
The Public Ministry claims that this action was not reported to them or to the Supreme Court that made the extradition request.
“This irregular situation would have failed the procedure stipulated by the Code of Criminal Procedure, which in its article 526 number 4, clearly establishes the development of the procedure to be followed once the decision of the Executive Power has been published, which authorized the presentation of a request for active extradition”, claims the prosecution.
César Hinostroza and his third extradition
Former Supreme Judge César Hinostroza faces his third request for active extradition, after Supreme Resolution 051-2022-JUS of March 11 indicated that the file was approved for the alleged commission of the crime of specific passive bribery to the detriment of the State.
In September 2021, the Supreme Court approved the prosecutor’s request to extend the extradition against Hinostroza Pariachi for allegedly having received financial favors from businessman Salvador José Ricci Cortez in 2015, as part of the Los Cuellos Blancos del Puerto case.
