Citizens will be able to record procedures at checkpoints and sales tax

Through joint resolution 109 se authorized the supervision and control of police action at checkpoints. Officials from the Public Ministry and the Ombudsman may be present at the control points in order to guarantee the proper functioning of the device.


Citizens will be able to make recordings in the procedures to which they are subjected at checkpoints and police and military checkpoints. This was established in joint resolution No. 109 published on September 7, signed by Defense Minister Vladimir Padrino López and Interior and Justice Minister Remigio Ceballos.

“No person may be forced to hand over their cell phone or recording equipment before, during or after the routine verification procedure carried out by the authorities at the control point, or to delete its content,” reads article 20.

According to the resolution, the retention of documents and belongings, including telephone equipment, may only be carried out in the cases established in the Organic Code of Criminal Procedure and other current legislation that establishes it.

The supervision and control of police action was authorized, so officials from the Public Ministry and the Ombudsman may be present at the control points in order to guarantee the proper functioning of the device.

“Each citizen security body, State security body or the Bolivarian National Armed Forces through the Territorial Defensive System, must establish a continuous mechanism of supervision of the control points under its responsibility, registering and directing the incidents that occur in the themselves; and designating a specific authority responsible for it”, dictates the resolution.

The organizations of popular power and the police social control committees may observe the operation and service provided at the checkpoints and make recommendations or complaints. Article 18 of the aforementioned resolution makes the obligations of officials clear: All security personnel must identify themselves and address citizens in a respectful and polite manner.

“Respect at all times the dignity and personal integrity of the citizens who pass through the checkpoint,” it reads. When it is necessary to perform the body check, they must do so in a “non-invasive” way.

The police officer is also obliged to inform what procedure will be carried out and to carry out the corresponding verifications “without this implying unnecessary delays or irreparable damage to people and their property.”
