Havana Cuba. – On August 29, Landy Fernández Elizástigui presented a request for a Special Review Procedure for the case of his brother, the political prisoner Luis Robles Elizástigui, before the Cuban Ministry of Justice (MINJUS).
In the petition, established in accordance with Title VIII of the new Criminal Procedure Law, Fernández Elizástigui stated that the detention and subsequent investigation of his brother were “illegal.”
The young man requested that the typification of the crimes of enemy propaganda and disobedience charged to his brother be reviewed, since the actions carried out by Luis Robles correspond to the constitutional rights of demonstration and freedom of expression, endorsed in articles 56 and 54 of the Magna Carta, respectively.
“There are no photos, video, or any evidence or causal link that relates the aforementioned Alexander Otaola with Luis Robles, in addition to the fact that in the act of the alleged crime it was not heard that he was carrying out those actions obeying designs, nor responding to any call to demonstrate. ”, reads the letter, to which he had access CubaNet.
Fernández Elizástigui also requests a review process of the case of Luis Robles due to the “violation of the legal grounds of the sentence where the legal qualification of the proven facts, in case of disobedience, is incorrect.”
The lawsuit states that the police officers did not present an arrest warrant, or a document from the Prosecutor’s Office or from any court, so that, since Luis Robles was not committing a crime, he was not obliged to be led by police officers.
“On the contrary, the police officers committed the crimes of deprivation of liberty, coercion, crimes against the free expression of thought, crimes against the rights of assembly, demonstration, association, complaint and petition,” the request states.
Last June, the family of Luis Robles filed an appeal before the People’s Supreme Court. However, the regime’s response was “no place.”
The young man from Guantanamo has been in the Combinado del Este prison for a year and eight months, serving a sentence for the alleged crimes of disobedience and enemy propaganda.
