SENTENCE OF A CASE OF RAPE OF A MINOR WITH DISABILITIES
The prosecutor raises the accusation in the events that occurred on February 23, 2020, in the midst of a state of emergency due to the COVID-19 pandemic.
It was more than 5:00 p.m. when the minor moved from the town square to her home. This in order to get a skirt to rehearse carnivals.
It is on this route that the defendant appears in the company of four other people in a car.
According to the prosecutor, the subjects grabbed the minor, covered her mouth and put her in the vehicle, and then took her to a desolate place where the accused committed sexual abuse.

For their part, the other young people acted as lookouts at the foot of the road, and one of them even filmed with a cell phone.
After committing the insult, the subjects left the place. On her part, the minor went to the town to report what had happened, and she is found crying desperately for her father.
Faced with this accusation, the defense claimed innocence, arguing that the accused and the victim had a relationship and that the sexual acts were with the consent of the female.
After evaluating the arguments, the Collegiate (made up of judges Hernán Pozo, Kati Jurado and Amparo Fernández) sentenced the accused to 21 years of effective sentence and the payment of 3 thousand soles of civil compensation in favor of the injured party.
