The Popular Action caucus presented the constitutional reform bill No. 2910/2022, which seeks to modify article 92 of the Political Constitution of Peru so that legislators cannot hold a ministerial position.
The initiative, authored by parliamentarian Luis Aragón, proposes that the article be modified as follows: “The mandate of the congressman is incompatible with the exercise of any other public function, which includes the performance of ministerial positions; except the performance, prior authorization of Congress, of extraordinary commissions of an international nature”.
The explanatory statement of this bill supports a need to “strengthen the division of powers of the State.” Likewise, it indicates that there is a difference between the functions required to be ministers and congressmen.
“Among the functions that congressmen have, is that of political control and supervision regarding the acts of the Executive, for which it is incompatible that, having the position of congressman, he can hold the position of Minister of State”, bases the initiative.
Currently, in the cabinet of Aníbal Torres there are two parliamentarians who serve as ministers. These are: Betssy Chávez (Democratic Peru) in the Culture portfolio and Roberto Sánchez (Democratic Change – Together for Peru) in the Tourism sector.
