The defense lawyers for the leader of the Arauco Malleco Coordinator (CAM), Hector Llaitul, Rodrigo Román and John Maulen, will seek the release of the so-called Mapuche weichafe by filing an amparo appeal before the Temuco Court of Appeals, arguing that “what being pursued are ideas”.
At a press point held on the outskirts of the Biobío Region Penitentiary Compliance Center (CCP), Román pointed out that together with Llaitul they are convinced that “there is a political operation and that what is being pursued are ideas, they are sayings “. And they accuse “it is intended to criminalize what is not criminalizable, which are crimes of expression.”

Llaitul’s defense attorney stated that first thing on Monday, August 29, “we are going to file a constitutional action for amparo so that the excellent Supreme Court will be the one that deals with the merits of the matter in the coming weeks.” Román added that “the responsibility of the State of Chile before the international community is being compromised, because the criminalization, the political and ideological persecution, of ideas, of expressions, of course, not only contravenes our legal system, but also contravenes what various international instruments have indicated.
The jurist explained that the amparo appeal has two objectives. “In the first place, precisely revoke preventive detention and opt for his quick release, removing the State Security Law from its formalization.” On the other hand, if the Temuco Court of Appeals does not consider the measure, “procure its faster transfer to the Temuco CDP, to the community module.” Said unit “is designed specifically for community members, we are not applying for a privileged situation,” Román emphasized.
Llaitul’s defense classified the case against the CAM leader as “Operation Hurricane 2” due to the existence of what in his opinion is “doubtful evidence”, such as the account of a former police officer and that of a protected witness who indicated that he recognized Llaitul at night, hooded and dressed in black.
“The sources of the accusation are the harangues that the peñi Héctor Llaitul would have made both in speeches and in interviews, that would mean sanctioning an ideological crime, which modern criminal law does not admit here or anywhere.
