The full of National Board of Justice (JNJ) dismissed a prescription request in favor of Sergio Martínez Castro, supernumerary judge of the Oyón Mixed and Unipersonal Criminal Court of the Superior Court of Huaura, and dismissed him for favoring a police promotion through an amparo action.
In the presentation of Disciplinary Procedure No. 173-2020-JNJ by Imelda Tumialan Pintoit was proven that the investigated had a favorable treatment with the plaintiff, by acting with partiality and allowing him to benefit from a promotion in rank in the PNP.
He stressed that the magistrate accepted an amparo action on violation of fundamental rights in favor of the plaintiff, without developing the due factual and legal motivation, going against established jurisprudence.
“His direct and intentional participation in the acts he carried out, for the benefit of third parties, making personal interest prevail over public interest is proven”Tumialán detailed in his presentation.
In this sense, the plenary session of the JNJ unanimously determined that Sergio Martinez Castroincurred the very serious offense provided for in article 48, paragraph 13, of the Law of the Judicial Career, and imposed the sanction of dismissal.
