Adrián Fernando Novelo Pérez, head of the first district court residing in Yucatán, denied the definitive suspension to a civil association identified as CN de LE and to a private individual, whose initials are CRJL, against the continuation of the construction work on sections 5 south and 6 of the Mayan Train, which go from Playa del Carmen to Tulum and Tulum-Bacalar, in Quintana Roo.

However, the judge granted the definitive suspension to the citizen CRJL, who claimed the failure of the Environmental Impact and Risk Directorate of the Environment and Natural Resources Secretariat (Semarnat) to apply the environmental impact and risk policy in the section 5 north of the project, as well as participating in the formulation of the Mayan Train works.

The suspension granted is also against the verbal order of Fonatur Tren Maya Sociedad Anónima de Capital Variable for the clearing of the jungle located along section 5 of the Tren Maya Project, as well as the omission to carry out the evaluation procedure of environmental impact contemplated by the General Law of Ecological Balance and Environmental Protection, and to Fonatur for the omission to carry out the soil mechanics studies related to sections 5 and 6.

On Monday, the judge denied two definitive suspensions that were part of the amparo lawsuits promoted by the civil association Cenote Republic and residents of the area.

Likewise, last week it revoked three definitive suspensions granted in the amparo trials promoted, among others, by the civil association Defending the Right to a Healthy Environment (DMAS) and inhabitants of the municipality of Solidaridad, Quintana Roo.

In this regard, Fonatur announced that the legal obstacles to continue with the construction of section 5 south of the Mayan Train were completely eliminated; however, now they are seeking to eliminate a new suspension on section 5 north, which runs from Cancun to Playa del Carmen.

Section 5 South has already been completely released. The definitive suspension of amparo 1137/2022 was denied, which rendered the last provisional suspension null and void. The Mayan Train will greatly benefit the southeast and even those who are against the workMay Rodríguez posted on her Twitter account.

This is the sixth amparo that existed against the construction of section 5 south that was revoked by state authorities.
