President Jair Bolsonaro today (10) revoked the decree, published yesterday (9), which modified the regulation of the profession of realtor. According to him, representatives of the sector will be consulted and a new document must be edited.
“I make mistakes too, as this week I made a mistake and there’s no problem going back. I determined this morning, it has already been published in the Official Diary of the Union [DOU] The revocation of the decree dealing with brokers. Let’s go ahead, let’s listen to the sector and improve the decree”, said the president, in Brasília, at an event promoted by the Confederation of Agriculture and Livestock of Brazil (CNA).
According to the Ministry of Economy, the changes were intended to encourage free competition in the real estate intermediation sector, making the definition of real estate intermediation activity more precise.
“Other activities, such as advertising or marketing real estate and ancillary services such as service to the general public – such as those carried out by receptionists, or the distribution of pamphlets – are not exclusive activities of the brokerage profession. Real estate intermediation is maintained as the exclusive activity of the trained realtor and duly registered in the professional council”, explained the folder about the changes now revoked.
In addition, the new rule provided that price lists for brokerage services would have a merely referential role, and could not be used as a floor or ceiling in defining the amounts to be charged by brokers in the performance of their duties. Another modification aimed at reducing bureaucracy and reducing transaction costs clarified that the registration of the association contract between brokers and real estate agencies would not be an essential requirement for the validity of the contract and for legal purposes.
The decree also dealt with the procedures for entering the profession of realtor and gave a period of 90 days for the Regional Council of Realtors in the jurisdiction to issue the registration. In addition, “the proposal also incorporates the principle of retroactivity of the rule most beneficial to the accused of disciplinary sanction”, explained the ministry.
National Agricultural Meeting
Bolsonaro participated in the opening of the National Agro Meeting, promoted by the CNA. During the event, the document “What we expect from the next government officials” was presented, with the demands of the agribusiness sector for candidates for the Presidency and the legislature in this year’s elections. The text deals with food security, economic and social development and sustainable development.
For the president of the CNA, João Martins, the sector needs to position itself on the various important issues for the country, in addition to agricultural production, so the document also addresses issues of education, health, employment and security.
“The whole world is waiting for Brazil to consolidate itself as the first and safest granary in the world. But we are into producing, we have technologies, equipment, but we need much more. We need Brazil to modernize, for the National Congress that will be elected to have the courage to vote on the major reforms that Brazil needs,” he said.
