The Federal Supreme Court (STF) granted this Monday (1st), injunctions to the states of São Paulo and Piauí that allow financial compensation for the loss in the collection of the Tax on Operations related to the Circulation of Goods and on Provision of Interstate Transport Services. and Intermunicipal and Communication (ICMS).
A federal law that came into force in June reduces ICMS, which is a state tax, in several sectors considered essential, such as fuel, natural gas and electricity, for example.
The injunctions were granted by STF Minister Alexandre de Moraes. He justified the decision on the grounds that the measure causes a deep imbalance in the states’ accounts and that they can seriously or irreversibly compromise the continuity of public policies or the provision of essential services to the community.
This financial compensation for the states will be made through the abatement of the states’ debts with the Union.
Maranhão and Alagoas also obtained injunctions in the STF that allow for financial compensation.
