President says that new demarcations may make agribusiness unfeasible

The President of the Republic, Jair Bolsonaro, said today (15) that the result of the judgment in the Federal Supreme Court (STF) of the time frame for demarcation of indigenous lands could make agribusiness in the country unfeasible. According to him, if the STF allows the recognition of new areas of traditional indigenous occupation after 1988, the decision “simply bury Brazil”. “We know that if we lose, I will have to make a decision. Because I understand that this new time frame simply buries Brazil. There are things that are obvious, and we cannot understand why certain people act against their homeland, they are unbelievable things”, said the president at the event Moderniza Brasil – Business Environment, organized by the federal government and held at the Federation of Industries headquarters of the State of São Paulo (Fiesp).

At the end of August, the STF resumed its judgment on the timeframe for demarcating indigenous lands. The Court judges the case on the dispute for the possession of the Ibirama Indigenous Land, in Santa Catarina. The area is inhabited by the Xokleng, Kaingang and Guarani peoples. The process has what is called general repercussion. This means that the decision that is taken will serve as a beacon for other similar cases that are decided throughout the Judiciary.

The STF ministers voted whether the indigenous would only have the right to the lands that were in their possession on October 5, 1988, the date of the promulgation of the Federal Constitution. The result is 1 to 1: Minister Nunes Marques voted in favor of the thesis. Minister Edson Fachin, on the other hand, spoke out against the time frame. In September, minister Alexandre de Moraes asked for a review of the action and there is no deadline for resuming the trial.
