Deputies approve in first reading the Extinction Law with modifications

Santo Domingo.- The Chamber of Deputies declared an emergency and unanimously approved this Thursday in first reading the Bill of Domain Extinction with a series of modifications and summoned the deputies to meet it in second reading this Friday.

The piece, which was approved unanimously by the 161 deputies present at the session, will have to be ratified in the second reading and will then be returned to the Senate for its consideration to approve or reject the modifications.

The president of the Chamber of Deputies, Alfredo Pacheco, read point by point the modifications that were made to the bill that had already been approved by the Senate.

He indicated that for the Chamber it is extremely important to approve this law, it is necessary to comply with the provisions of the Constitution of the Republic.

“Now I am correcting, because I learned along the way that a law like this should be presumed, which is directed at things, not at the person, is that good faith is presumed and that basically the citizens who were subjected to a trial ownership had the possibility of exhausting due process,” he emphasized.

He argued that as president of the Chamber of Deputies he consulted with the different benches of the political parties, which caused a consensus to be drawn up to draft a law in accordance with the Dominican Constitution.

Deputies from the different benches welcomed Pacheco’s actions for having achieved consensus for the approval of such an important initiative.

The Domain Forfeiture bill approved in two readings by the Senate of the Republic contains 11 articles, of which the Chamber of Deputies made 36 modifications.

Object of the law

The purpose of this law is to regulate the process of extinction of ownership of illicit assets, provided for in the Constitution of the Dominican Republic; establish the procedure that allows to make said institute effective; define the competencies and powers of the authorities responsible for its application; recognize the rights and guarantees of the participants and affected parties.

In addition, lay down the fundamental principles for the operation of the system of administration of the assets that this law deals with; as well as the procedure required for its judicial declaration in favor of the Dominican State, observing due respect for the rights of third-party creditors.

Said law establishes that the domain forfeiture procedure is independent and autonomous from the criminal, civil or any other jurisdictional, administrative or arbitral procedure.

The existence of another judicial proceeding may not be an obstacle to the commencement of a domain forfeiture proceeding.
