Government raises to 9 UIT the limit to make purchases and contracts with the State without public competition

The Government approved this Tuesday, July 19, through the agreement , raise to 9 tax tax units (UIT) the limit for making purchases and contracts without the need for a public tender. In this context, Mónica Yaya, former president of the OSCE Court, described this decision as dangerous, since it widens the margin for hand-picked by public officials.

“This is dangerous for the proper use of our resources, let us bear in mind that in 2019 only in this type of contracting, which also hides unnecessary consultancies, between S/ 8,000 and S/ 9,000 million was spent at the end of the year”, indicated in an interview with Successful.

Yaya points out that there is no specific data on how much was spent on consultancies in 2020, “but we already imagine how they are going to be fired for proselytizing purposes to hire relatives and political allies without these hirings being necessary.”

Another important point is that this type of contracting and consultancies, which do not require a public tender, make up a third of the budget allocated for State contracting.

“In practice (this rule) means that there will be more consultancies, hand-picked contracts without any control or competition. If at this moment the hiring of less than 8 UITs do not require a selection process and they are already a third of the budget allocated for State hiring, let us imagine what it will be like now that the fence rises to 9 UITs”points out the former president of the OSCE.

On the other hand, the decision to raise this barrier to 9 UIT would imply in a concrete way that the State would be allocating up to S/ 41,400 of the budget to pay for this type of contracting, a scheme used to “designate positions by finger”.

“Today, with the fence that exists until today of 8 UITs, we are talking about contracts equal to or less than S/ 36,800 with which friends, relatives of ministers are hired or to exchange political favors. If the current value of the UIT is taken into account and if the fence is raised to 9 UIT, we would be paying contracts that exceed S/ 41,400 or less”, highlights Monica Yaya.

What is the justification for the rule?

The specialist maintains that the basis mentioned in the standard is generic, since it is based on the powers of the Board of Directors of the State Procurement Supervisory Agency (OSCE), but there is no technical reason explained.

Mónica Yaya even states that this norm would have been approved without any prior justification and that the main reason would have been of a political nature.

“According to information that internal sources of the MEF have provided me, the justification was opened after the decision to raise the fence from 8 UIT to 9 UIT. That is to say, the justification has been worked on, which has not been published by the way, more political than technical, to serve as a screen for a decision that would have been taken before (if the resolution was approved) “, finished.
